Terms of Use

Welcome to Color the Picture (the “Service,” the “Site,” the “App”). Color the Picture is an AI-powered coloring-page web application designed for children, available at colorthepicture.com.

These Terms of Use (the “Terms”) govern the legal relationship between Color the Picture, the operator of the Service (“we,” “us,” “Color the Picture,” the “Company”), and you, the user of the Service (“User,” “Parent,” “you”). By registering for, logging into, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree to these Terms, please do not use the Service.

Important: Nothing in these Terms takes away any mandatory consumer rights or data-protection rights you may have under the law. Any non-waivable rights you hold under applicable mandatory law — including consumer-protection law in your country of residence, the EU General Data Protection Regulation (“GDPR”) where applicable, and, for users located in Türkiye, the Turkish Law on the Protection of Personal Data No. 6698 (“KVKK”) — remain fully in effect. To the extent any provision of these Terms conflicts with such rights, that provision will not apply.

Definitions:

  • Parent / Account Holder: An adult (18 years of age or older) who opens and controls an account, acting as a parent or legal guardian.
  • Child Profile: A sub-profile created under a Parent’s account for a child (approximately ages 3–13).
  • Content: Photos you upload, theme text you write, colored artwork, drafts, and any other data submitted to the Service.
  • AI Output: Coloring pages (line art) and related outputs generated using artificial intelligence.

2. Description of the Service

Color the Picture is an AI-powered coloring-page platform designed for children, families, and teachers. Key features include:

  • A ready-made coloring library (color online and/or download)
  • Credit-based AI coloring-page generation (line art generated from photos and text prompts)
  • A digital coloring canvas (color online)
  • A parent-supervised child-profile system
  • A child-friendly gallery moderated by our administrators
  • Gamification (points, levels, badges)
  • Premium subscription plans (Premium / Family / Teacher)

The features, scope, and pricing of the Service may change from time to time. Current features and pricing are published on the Site.

3. Account Model, Age Requirement, and Parental Consent

3.1. Accounts Are for Parents/Legal Guardians

All accounts on the Service are intended for adults aged 18 or older acting as a parent or legal guardian. Children may not open accounts directly; children are managed as Child Profiles under a Parent’s account.

3.2. Parent Representations

By creating an account, you represent and warrant that:

  • you are at least 18 years old and have full legal capacity;
  • you are the parent or legal guardian of any child for whom you create a Child Profile, or you are otherwise authorized to act on that child’s behalf; and
  • you have the authority to give any consent required, on the child’s behalf, for the processing of the child’s personal data and for the child’s use of the Service.

3.3. Verifiable Parental Consent (COPPA)

For users in the United States, the processing of personal data of children under 13 is based on verifiable parental consent as required under the Children’s Online Privacy Protection Act (“COPPA”). For users located in Türkiye, equivalent consent requirements apply under the KVKK. The Parent provides this consent when creating an account and adding a Child Profile, and may withdraw it at any time (see Section 8).

3.4. Accuracy and Security of Account Information

  • You are responsible for ensuring that the information you provide at registration (email, name) is accurate and kept up to date.
  • You are responsible for keeping your password confidential and not sharing it with anyone. Passwords are stored on our systems in irreversibly hashed form using bcrypt; we cannot view your password in plain text.
  • If you notice unauthorized access to your account or any suspicious activity, you must change your password immediately and contact us.

4. User Content and Intellectual Property

4.1. Photos You Upload and Theme Text

  • Photos you upload for AI generation are not permanently stored on our servers. They are processed temporarily (in base64 format) and transmitted to our AI provider (Google Gemini). They are not retained once processing is complete. See the Privacy Policy for details.
  • For every photo and piece of theme text you upload, you represent that you hold all rights necessary to upload and process that content, and that doing so does not infringe any third party’s intellectual property, personality, or privacy rights.
  • Uploading photos of third parties without authorization — for example, another person’s child, images of public figures, or copyrighted characters — is strictly prohibited.

4.2. Colored Artwork and Gallery Sharing

If you choose to share your child’s colored artwork in the child-friendly gallery:

  • you represent that the artwork is appropriate for the community and safe for children;
  • the artwork is subject to administrator moderation before publication; content found inappropriate will not be published;
  • you grant Color the Picture a worldwide, non-exclusive, royalty-free, sublicensable license to display the shared artwork within the Service and to use it in promotional and marketing materials, and to reproduce or adapt it as technically necessary. This license applies only to artwork you actively choose to share;
  • intellectual property rights in the artwork remain with you (your child); the license above does not transfer ownership;
  • you may remove shared artwork from the gallery at any time; upon removal, the artwork will be taken down within a reasonable technical timeframe. However, we may have no technical control over copies that third parties downloaded or reproduced in good faith before removal.

4.3. AI-Generated Content

  • Coloring pages generated by AI are provided for your personal use (coloring, downloading, printing).
  • Commercial use rights depend on the subscription plan you have purchased and are subject to the current plan terms published on the Site.
  • AI generation is performed using the Google Gemini infrastructure, and that provider’s terms of use also apply.
  • The copyright status of AI-generated content remains unsettled in many jurisdictions. We recommend seeking independent legal advice before any commercial use. Color the Picture makes no warranty regarding this legal uncertainty.

4.4. Platform Intellectual Property

The software, design, logo, trademarks, ready-made coloring library content, and all other elements of the Service belong to Color the Picture or its licensors and are protected by intellectual property law. No rights are granted to you other than those expressly set out in these Terms.

5. Subscriptions, Credits, and Payment

5.1. Subscription Plans

The Service offers a free tier alongside paid Premium, Family, and Teacher subscription plans. Plan scope, credit limits, and pricing are published on the Site and may be updated from time to time. Price changes do not affect your then-current subscription period; changes take effect starting with your next renewal period.

5.2. Free Trial (7 Days)

  • Eligible users may take advantage of a 7-day free trial.
  • No payment is automatically charged at the end of the trial; unless you choose otherwise, you will be moved to the free tier.
  • To prevent abuse, the trial is offered once per account/email address, and a used trial may not be restarted.

5.3. Credits

  • AI generation incurs real processing costs; accordingly, it is credit-based and subject to real usage limits. We do not offer “unlimited AI” as a feature.
  • Monthly subscription credits may reset at the end of each billing period (unused credits may not roll over to the next period). Rollover rules, if any, are governed by the plan terms in effect at the time of purchase.

5.4. Payment and Merchant of Record

  • Payments are processed by Lemon Squeezy acting as the “Merchant of Record.” This means billing, tax collection, and payment processing are handled by Lemon Squeezy.
  • Your card and payment details are not stored on Color the Picture’s servers; they are processed directly by Lemon Squeezy.
  • Details on refunds, cancellations, and billing are set out in the Refund and Cancellation Policy. Any statutory withdrawal rights and other mandatory consumer-protection rights available to you under the law of your country of residence remain unaffected.

6. Account Deletion and Data Management

6.1. Deleting a Child Profile

You may delete a Child Profile from your profile settings. Doing so permanently deletes all of that child’s artwork, drafts, and badges; this action cannot be undone. We recommend using the “Download My Data” feature to make a backup before deleting.

6.2. Deleting Your Account

You may permanently delete your account from your profile settings, subject to password confirmation. Doing so permanently deletes your account, all Child Profiles, any content you uploaded, and your credit balance, and cancels any active subscription. This action cannot be undone.

  • Deletion is recorded in an audit log as required by our legal obligations. These records may be retained for the legally required retention period (5 years for deletion records).

6.3. Withdrawing Consent

Where processing is based on your consent, you may withdraw that consent at any time under applicable data-protection law (including the GDPR and, for users in Türkiye, the KVKK). Withdrawal can be done on a self-service basis through your profile settings or by contacting kvkk@colorthepicture.com. See the Explicit Consent Notice for details.

6.4. Cancel Your Subscription Before Deleting Your Account or Withdrawing Consent

We recommend canceling any active subscription before deleting your account or withdrawing your consent. Otherwise, notification delays at the payment provider could result in one final charge; in that case, you may need to contact the payment provider directly for a refund.

7. Prohibited Uses

The following conduct is prohibited and may result in suspension or termination of your account:

  • uploading or generating content that is not appropriate for children (sexual, violent, hateful, frightening, or unlawful content);
  • uploading copyrighted content belonging to others without authorization;
  • uploading photos of third parties (particularly children) without authorization;
  • attacking the Site’s infrastructure (DDoS attacks, unauthorized scraping, brute-force attacks, etc.);
  • using multiple accounts to abuse or attempt to manipulate the trial or credit system;
  • posting advertising, spam, or malicious links in the gallery or elsewhere on the Service;
  • gaining or attempting to gain unauthorized access to another user’s account;
  • any use that violates applicable law.

8. Protection of Personal Data

8.1. Data Controller and Categories of Data Processed

Your personal data is processed by Color the Picture acting as data controller. The main categories of data we process are:

  • Parent: email address, name, password (bcrypt hash), IP address, device/browser information, subscription/payment status.
  • Child Profile: nickname, avatar, colored artwork, drafts, game scores, badges.
  • Photos uploaded for AI processing: processed temporarily (base64), not permanently retained.

8.2. Legal Bases for Processing

Depending on the purpose of processing, your data is processed on the following legal bases:

  • Consent (for example, processing of a child’s data, or analytics cookies where you have opted in);
  • Performance of a contract (account creation, providing your subscription);
  • Compliance with a legal obligation (statutory retention, audit records);
  • Legitimate interests (security, abuse prevention, service improvement — only to the extent this does not override your fundamental rights and freedoms).

8.3. Third-Party and International Data Transfers

To provide the Service, your data may be shared with the following service providers:

  • Google Cloud / Gemini — AI image generation;
  • Google OAuth — login/authentication;
  • Google Analytics 4 — anonymized analytics (only where you have consented via cookie settings);
  • Lemon Squeezy — payment processing (Merchant of Record);
  • Hetzner — hosting (servers located in Germany/EU).

Additional providers — such as Sign in with Apple or email-delivery providers (e.g., Resend/SendGrid) — may be added in the future; if so, the Privacy Policy will be updated accordingly.

Some of these transfers may involve sending data outside your country of residence. International transfers are carried out in accordance with the safeguards required by applicable data-protection law (such as the GDPR and, for users in Türkiye, the KVKK), including consent and/or appropriate transfer mechanisms as required.

8.4. Retention Periods

  • Account data is retained for as long as the account remains active;
  • deletion/audit records are retained for 5 years as required by law;
  • system logs are retained for 90 days.

8.5. Your Data Protection Rights

You have the right to access, correct, and delete your personal data (including the right to erasure), to restrict processing, to receive your data in a portable format (JSON), and to withdraw consent, as provided under applicable data-protection law — including the GDPR and, for users located in Türkiye, Article 11 of the KVKK. These rights can be exercised on a self-service basis through your profile or by contacting kvkk@colorthepicture.com. See the Privacy Policy for details. If you are located in the EU/EEA, you also have the right to lodge a complaint with your local data protection authority.

8.6. Security

We apply reasonable technical and organizational measures to protect your data, including bcrypt password hashing, encrypted communication via HTTPS/TLS, audit logging, and role-based access control.

9. Modification, Suspension, and Termination of the Service

9.1. Service Interruptions

The Site may be temporarily unavailable due to maintenance, updates, or technical issues. Uninterrupted access is not guaranteed. We will make reasonable efforts to provide advance notice of significant planned outages.

9.2. Right to Modify or Suspend

Color the Picture reserves the right to modify, enhance, restrict, or discontinue the Service, in whole or in part, at any time. If a paid feature is permanently discontinued, your rights under applicable mandatory consumer-protection law remain unaffected.

9.3. Suspension or Termination of Your Account

If you violate these Terms (in particular Section 7), we may:

  • temporarily suspend your account after a warning;
  • terminate your account for repeated violations;
  • immediately terminate your account and report the matter to the relevant authorities in the case of serious violations, such as child-exploitation content.

9.4. Third-Party Dependencies

The Service depends on the third-party providers listed in Section 8.3. Outages or failures at these providers may affect the Service. In such cases, we will make reasonable efforts to provide alternative solutions (for example, an alternative model or service).

10. Disclaimer of Warranties

  • The Service is provided “as is” and “as available.”
  • To the maximum extent permitted by applicable law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free performance.
  • We do not guarantee the accuracy, quality, consistency, or suitability of AI-generated content for your expectations; AI is a probabilistic technology and may produce unexpected outputs.
  • This section does not limit any non-waivable statutory rights you hold as a consumer.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Color the Picture is not liable for indirect, incidental, special, punitive, or consequential damages (including loss of data, loss of profits, or loss of reputation).
  • Color the Picture’s total liability for any claim is limited to the total amount you paid us for the Service in the 12 months preceding the event giving rise to the claim.
  • The limitations above do not apply to liability arising from our intent or gross negligence, death or personal injury, or any other liability that cannot be limited under applicable law. Your mandatory rights as a consumer remain unaffected.

12. Indemnification

You agree to indemnify Color the Picture, to the extent of your fault, for direct damages, claims, and expenses (including reasonable legal fees) that we incur as a result of your use of the Service in violation of these Terms or applicable law, or as a result of content you upload infringing the rights of third parties (including intellectual property or personality rights).

13. Force Majeure

We are not liable for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, fire, epidemics, war, cyberattacks, infrastructure or third-party service outages, or actions by government authorities.

14. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of Türkiye.
  • The courts and enforcement offices of Istanbul, Türkiye have jurisdiction over any dispute. For disputes in which you qualify as a consumer, the competent Consumer Arbitration Committees and consumer courts also have jurisdiction, within the relevant monetary limits.
  • Any mandatory consumer-protection and data-protection rights available to you under the law of your country of residence remain unaffected and cannot be overridden by these Terms. If you are located in the EU/EEA, your rights under the GDPR — including the right to lodge a complaint with your local data protection authority — remain unaffected.

15. General Provisions

15.1. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect; the invalid provision will be deemed replaced by a valid provision that most closely reflects its intended purpose.

15.2. Entire Agreement

These Terms, together with the Privacy Policy, the Explicit Consent Notice, the Cookie Policy, and the Refund and Cancellation Policy, constitute the entire agreement between the parties.

15.3. No Waiver

Our failure or delay in exercising any right under these Terms does not constitute a waiver of that right.

15.4. Assignment

You may not assign your rights or obligations under these Terms to any third party without our prior written consent. Color the Picture may assign these Terms to a third party in connection with a restructuring or transfer, provided your rights continue to be protected.

16. Changes to These Terms

If we make material changes to these Terms:

  • the change will be announced on the Site;
  • a notification will be sent to your registered email address;
  • the change will take effect on the date of publication or on the date specified in the notice.

Your continued use of the Service after a change takes effect constitutes your acceptance of the updated Terms. If you do not agree to the changes, you may delete your account.
